Terms of Service

These Terms of Service (“Terms”) form a binding legal agreement between you (“User”, “Client”, or “you”) and Sparklify Flow (“we”, “our”, or “Sparklify”), governing your use of our platform and related services (“Platform”).

By accessing or using Sparklify Flow, including any free trial or paid subscription, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

We may update these Terms at any time. Updates will be communicated via the website at least 7 days before they take effect. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

Communication Consent

By accessing or using the Platform, you consent to receiving communications from Sparklify Flow through various channels, including but not limited to:

  • Email

  • SMS

  • WhatsApp

  • Facebook Messenger

  • Phone (calls and/or voicemails)

These communications may include service updates, account notifications, onboarding instructions, billing information, and occasional promotional content.

In accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR), you may withdraw your consent or update your communication preferences at any time. This can be done through your account settings or by using the unsubscribe or opt-out options included in our messages.

Please note that opting out of certain types of communication may affect your ability to receive important service-related updates.

  

Platform Usage & Conduct

You may only use the Platform for lawful business purposes.

You agree not to:

  • Scrape, reverse engineer, or tamper with the Platform.

  • Share access credentials.

  • Interfere with the Platform’s functionality.

You must comply with all applicable laws and regulations, including GDPR, CAN-SPAM, and other privacy, data, and marketing laws.

  

Subscription, Billing & Refunds

  • Access to the Platform is provided via paid subscription.

  • All subscriptions auto-renew unless cancelled before the next billing cycle.

  • No refunds are offered for monthly plans.

  • Annual plans (when implemented) may be eligible for a refund within 24 hours of purchase.

  • Users who do not convert after the 7-day trial may be deleted from the Platform.

  • We may suspend access to the Platform for non-payment or suspected abuse.

  

Client Data & Privacy

  • You are solely responsible for ensuring your use of the Platform and your handling of data complies with all applicable data protection laws.

  • You must secure your own data and configure the Platform’s features responsibly.

  • By using the Platform, you agree to share certain data with Sparklify Flow to enable the functionality of the service.
  

Infrastructure & Service Limitations

  • Sparklify Flow operates on third-party infrastructure. In the event of downtime or discontinuation by the upstream provider, we cannot be held liable for service interruptions, data loss, or access issues.

  • The Platform is provided “as-is” without warranties or guarantees.

  • We are not responsible for notices or restrictions from third-party platforms (e.g., LinkedIn) that may result from your use of automation features.

  

Termination

  • We may terminate or suspend your access to the Platform at our sole discretion if you breach these Terms or abuse the service.

  • Upon termination, your access is revoked and data may be deleted.

  • No refunds are provided for remaining subscription time.

  

Limitation of Liability

  • We are not liable for indirect, incidental, or consequential damages.

  • You agree Sparklify Flow is not responsible for any platform outages, bugs, data loss, or third-party service failures.

  

Miscellaneous

  • These Terms are electronically accepted and have full legal effect.

  • Communications should be directed to support@sparklify.io.

  • If any section of these Terms is found unenforceable, the remainder shall remain in effect.

  • These Terms constitute the full agreement between you and Sparklify Flow.
